1. Acceptance of Terms
By registering for or using the StayVanta hospitality platform ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree, you may not use the Service. The Service is operated by Stayvanta Technologies (see section 13).
2. The Service
StayVanta provides hotels and other accommodation providers with cloud-based tools to manage rooms, rates, bookings, guests, billing, housekeeping and their public website presence. We may change, suspend or discontinue any part of the Service at any time, with reasonable notice where practical, and we are not liable for such changes.
3. Accounts and Registration
- You must provide accurate and complete information when registering and keep your account credentials confidential.
- You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorised use.
- You must be at least 18 years old to open an account.
- You may not register multiple accounts to avoid plan limits or misrepresent your hotel.
4. Hotel Responsibilities
- You are responsible for the accuracy of the content you publish, including room descriptions, rates, policies and photos.
- You represent that you are authorised to operate the hotel and to accept bookings through the Service.
- You must comply with all laws applicable to your business, including consumer protection, data protection and tax obligations.
- You are responsible for the conduct of your staff and their use of the Service under your account.
5. Subscriptions, Billing and Payments
- Certain features require an active subscription to a paid plan. Fees are billed in advance on the cycle you select.
- Payments are processed through our approved payment channels. Late or failed payments may restrict access to paid features.
- Subscriptions renew automatically unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period.
- If a subscription is cancelled or lapses, access to paid features (including billing and finance modules) will be limited until you renew.
- We may update pricing by giving you reasonable notice. Continuing to use the Service after a price change takes effect constitutes acceptance.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in breach of any local, national or international law;
- Upload malicious code, attempt to breach security, or interfere with the operation of the Service;
- Copy, scrape, reverse engineer or resell any part of the Service without our written consent;
- Misrepresent your identity, hotel or affiliation;
- Use the Service to send unsolicited communications or process fraudulent transactions.
7. Intellectual Property
StayVanta and its licensors own all rights in the Service, including its software, design, logos and trademarks. You retain ownership of the content you upload to your hotel profile, and you grant us a limited licence to host, store and display that content to operate the Service. Please do not remove or obscure any proprietary notices.
8. Suspension and Termination
We may suspend or terminate your account if you violate these Terms, fail to pay applicable fees, or if required by law. You may stop using the Service at any time and cancel your subscription through your account settings. On termination, we will provide a reasonable period to export your data, subject to applicable law. We are not liable for losses arising from suspension or termination where permitted by law.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. While we work to keep the Service reliable, we do not warrant that it will be uninterrupted or error-free.
10. Limitation of Liability
To the maximum extent permitted by law, StayVanta will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amounts you have paid us in the twelve months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted, and where material we will notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Malawi. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Malawi.
